GENERAL CONDITIONS OF USE AND SALE
PREAMBLE
This document governs the general conditions of use of the website www.jackhammerworkwear.ma ("the Site") as well as the general conditions of sale (the "Conditions") between the company PREVENTEX, owner of the site (« JACKHAMMERWORKWEAR.MA») and any natural person aged at least 18, acting for their personal needs wishing to use the Site (“the User”) or make a purchase on the Site (“the Customer”).
Before using the Site, it is recommended that you read these Conditions, our cookie policy and our personal data protection policy (the “Data Protection Policy”) accessible in Article 11 - Personal Data Protection Policy below.
Use of the Site or placing an order on it constitutes unconditional and unreserved acceptance of the Conditions and the Data Protection Policy at the time of the order.
JACKHAMMERWORKWEAR.MA reserves the right to update or revise these Terms without notice. The Terms applicable to the User or Customer are those in effect at the time of use of the Site or placing of the order on the Site.
JACKHAMMERWORKWEAR.MA offers for sale ready-to-wear items and accessories, only from renowned brands. These products come directly from authorized producers and resellers ("the Products").
ARTICLE 1 - DEFINITIONS
The terms that will be defined below will have the following meaning: "CGU" means the General Conditions of Use that govern the use of the jackhammerworkwear.ma site. "SITE" means the jackhammerworkwear.ma site, which is accessible via a web browser. "User" means any person using the jackhammerworkwear.ma site. "Service" means all the features of the jackhammerworkwear.ma site made available to Users. "Content" means the data made available by the jackhammerworkwear.ma site. "Publisher" means the owner of the "jackhammerworkwear.ma" Site.
ARTICLE 2 - ORDER
2.1 Placing an order
The ordering process includes the following steps which the Customer is invited to follow by providing and verifying the information required in each of them:
- Addition by the Customer of the selected Product(s) to their basket, access to the basket being possible at any time for modification or validation;
- Validation of the basket after verification of its contents;
- Choice of delivery method;
- Choice of payment method and express acceptance of the Site Conditions;
- Redirection of the Customer to the secure online payment site for payment validation.
The Client's final agreement is therefore materialized by the validation of their banking details, namely the bank card number, the expiry date and the cryptogram.
2.2 Order validation
The Customer will receive an email confirming the validation of their order, summarizing the details of the items ordered.
Any order will only be taken into consideration after acceptance of payment.
Without prejudice to the provisions of Article 1 above, JACKHAMMERWORKWEAR.MA reserves the right to cancel or refuse any order from a Customer in the following cases:
- In the event of an incident of payment of the order;
- In the event of an order for products in abnormal quantities with regard to the quality of consumer;
- In the event of a dispute relating to the payment of a previous order placed on the Site;
- In the event of suspected fraud, based in particular on systematic complaints and/or returns from the Customer during previous orders;
- In the event of repeated non-compliance with the conditions for exercising the right of withdrawal during previous orders (products worn, washed, altered and/or damaged);
- In the event of a manifest error between the price displayed on the product and/or on one of the characteristics of the product;
- In the event of fraudulent use of our loyalty program, in particular by creating multiple customer accounts.
For this purpose, the Customer is informed that in order to avoid identity theft, JACKHAMMERWORKWEAR.MA may be required to request supporting documents to verify that the Customer is indeed the originator of the order. The personal data thus collected are processed in accordance with the privacy policy available on the link in article 11 hereof.
2.3 Product Characteristics
In accordance with Article L.111-1 of the Consumer Code, the Customer may, prior to placing an order, view on the Site the essential characteristics of the Products that he wishes to order presented in each of the product sheets.
2.4 Price
The prices displayed on the Site are expressed in Moroccan Dirhams, Dollars or Euros depending on the exchange rate of the day.
These prices include the VAT applicable in Morocco or that applicable in the country of delivery on the day of the order but are exclusive of delivery costs payable by the Customer. It is specified that customs fees are not included in the displayed price including VAT.
The prices of the different delivery methods can be consulted.
JACKHAMMERWORKWEAR.MA reserves the right to modify prices at any time, without such modification affecting an order that has already been validated.
2.5 Availability of Products
The order constitutes acceptance of the prices and description of the Products available for sale. JACKHAMMERWORKWEAR.MA undertakes to honor orders for Products within the limits of available stocks.
In the event of the unavailability of one or more Products after the order has been placed, JACKHAMMERWORKWEAR.MA undertakes to inform the Customer by email and telephone call as soon as possible of the timeframe in which the Product will be available again or, where applicable, of its unavailability. In the event of unavailability of Products, or if the Customer cancels the purchase, the order for the product concerned will be automatically cancelled and the corresponding amount will be refunded using the same means of payment as that used for the order.
2.6 Order modification
Once the order has been validated, it is no longer possible to modify it (delivery address or content). The Customer must therefore, upon receipt of the Product(s) subject to the order, return them in accordance with the provisions of Article 8 - Right of withdrawal below. JACKHAMMERWORKWEAR.MA recommends that the Customer place a new order the same day in order to have the desired size or model.
ARTICLE 3 - SHIPPING AND DELIVERY
3.1 Shipping of orders:

Delivery time is between 2 and 10 working days.
An email is sent to the Customer when their order is shipped from our warehouse. This email summarizes the chosen delivery method as well as the order tracking number. To obtain the details and tracking of your order, the Customer is invited to go to their personal space in the “My order tracking” section.
3.2 Place of delivery
The Products are shipped to the delivery address provided by the Customer during the ordering process. The Customer is informed that JACKHAMMERWORKWEAR.MA cannot be held responsible for the impossibility of delivering the order in the event of incorrect information when the Customer enters their delivery details.
JACKHAMMERWORKWEAR.MA delivers the Products in Morocco and outside Morocco through its partner ARAMEX international
3.3 Delivery times:
Except in cases of force majeure and excluding certain periods of high activity, such as sales periods, and subject to validation of the order and payment by the Customer:
Orders will be prepared and shipped under the terms and conditions of Article 3.1 above;
Shipping and delivery times will be indicated in Article 3.4 below, within the limits of available stocks. These times run:
For the shipping time, from the date of the order confirmation email;
For the delivery time, from the date of the shipping email sent by the Company to the Customer.
JACKHAMMERWORKWEAR.MA undertakes to inform the Customer by e-mail of the progress of the processing of his order.
Furthermore, to track their package, the Customer will log in to their customer account, then go to the "My personal space" section and click on "My order tracking". The Customer is informed that there is no delivery tracking for 24 hours following the order, as it is subject to prior processing by a sorting platform. After this period, the Customer will be able to track the delivery of their package directly on the website of the carrier selected when placing the order.
3.4 Delivery methods
JACKHAMMERWORKWEAR.MA offers the Customer the delivery methods detailed below.
3.4.1 Morocco
Throughout France and Corsica

Delivery in 48 hours to 10 days from Monday to Saturday.
The Customer can choose between home delivery, post office delivery or home delivery.
. Digitrad:
Delivery in 48 hours to 10 days from Monday to Saturday.
The Customer can choose between home delivery, post office delivery or home delivery.
. Amana:
Delivery in 48 hours to 10 days from Monday to Saturday.
The Customer can choose between home delivery, post office delivery or home delivery.
3.5 General provisions on the delivery of Products
It is the Customer's responsibility to check that the delivery complies with their order and to report any errors without delay. The Customer is also required to check the condition of the Products delivered.
Any package showing apparent anomalies (damage, product missing compared to the order form, damaged or opened package, defective product, etc.) at the time of its delivery or collection by the Customer must imperatively be the subject of a complaint addressed to customer service within 3 days following the date of delivery or collection via the form: https://jackhammerworkwear.ma/contact
The Customer must return the Product concerned by strictly following the Product return procedure described in Article 9.1, specifying the reason for return as "Non-compliant Product". The conditions for exercising the legal guarantees are detailed in Article 10 below.
If the anomaly is proven and confirmed by jackhammerworkwear.ma, the Customer will receive, subject to receipt of the package in the jackhammerworkwear.ma warehouses, an e-mail indicating whether the Product concerned can be exchanged or refunded. Where applicable, the refund of the Product, delivery costs and costs incurred for the return will occur within 14 days from the date on which jackhammerworkwear.ma has confirmed to the Customer that he is entitled to said refund in accordance with the Guarantees described in Article 10.
ARTICLE 4 - PAYMENT
4.1 Available payment methods
The Customer can pay for his order using the following methods:
- Payment on receipt for deliveries to Morocco.
- Payment by bank transfer.
- By bank cards.
Transactions carried out on the Site are entrusted to a secure online payment platform of the interbank monetary center CMI.
The payment data of the Customer's bank card (namely: card number, expiry date and visual cryptogram on the back of the card) will be encrypted by our service provider, which transmits this payment data to the bank, in complete confidentiality and makes it inaccessible to a third party.
Each time one of the pre-registered cards is used, the Customer must re-enter their account password and complete the cryptogram. The pre-registered card will only be offered if the same delivery address is used by the Customer for any subsequent order. The Customer has the option of deleting pre-registered bank cards in the "My bank cards" section of their Personal Space, or of adding other bank cards on the payment page when making their purchase.
4.2 Prevention and management of non-payments
Furthermore, in order to prevent non-payment, jackhammerworkwear.ma has set up a system which may lead to requesting additional information from the Customer during payment or to suspending an order.
4.3 Electronic invoice
An invoice in electronic format will be made available to the Customer on the Site in the “My personal space” section, which the Customer accepts.
ARTICLE 5 - TRANSFER OF RISKS AND OWNERSHIP
jackhammerworkwear.ma retains ownership of the Products until full payment of the order, i.e. receipt by jackhammerworkwear.ma of the full price and associated costs. These provisions do not prevent the transfer to the Customer, from their receipt, of the risks of loss and deterioration of the Products purchased as well as any damage they may cause.
ARTICLE 6 - INTELLECTUAL PROPERTY
All texts, comments, photos, brands, illustrations and images reproduced on the Site are protected both under copyright and intellectual property law. These elements are and remain the exclusive property of jackhammerworkwear.ma or the holder of the intellectual property rights concerned.
Any total or partial reproduction of the Site or of any of its elements, on any medium whatsoever and for any reason whatsoever, is strictly prohibited.
ARTICLE 7 - PERSONAL DATA PROTECTION POLICY
JACKHAMMERWORKWEAR.MA is committed to being as open and transparent as possible and to providing the Customer with all necessary information on how their Personal Data (as this term is defined in our Data Protection Policy) is collected, used and protected during their visits to the Site.
